ORDER OF THE FOREST SUPERVISOR RESTRICTING THE USE OF ROADS AND CONDITIONS OF USE ON THE HURON-MANISTEE NATIONAL FORESTS
Under the authority of the Act of Congress of June 4, 1897, as amended (16 USC 551), and Secretary of Agriculture’s Regulations 36 CFR 261.50(a)(b), the following acts and omissions are prohibited within the area and roads described in this order within the Huron-Manistee National Forests, Mio Ranger District.
- Entering or using the area between 9 pm and 6 am. 36CFR 261.58 (b)
- Being on the road between 9 p.m. and 6 am. 36 CFR 261.54 (e)
- Possessing a beverage that is defined as an alcoholic beverage by State law. 36 CFR 261.58 (bb)
This order applies to the area and roads defined below and shown on the map designated Exhibit A and attached hereto.
- Bull Gap Road #4276: Beginning at the gate at the junction with East Bull Gap Road #4332, (SWSE ¼, Section 24, T26N, R3E), to the gate at the junction with Colgrove Road #4329, (SESE ¼, Section 26, T26N, R3E) and 300 feet either side of centerline of this described road.
- Bull Gap Hill Climb Area (Sections 25 and 26, T26N, R3E), specifically identified on the ground with boundary markers.
These restrictions are necessary for public safety and to protect National Forest resources.
Pursuant to 36 CFR, Sec. 261.50 (e), the following persons are exempt from this order:
- Persons with a valid permit in their possession signed by the District Ranger or Forest Supervisor specifically authorizing the prohibited act or omission.
- Any Federal, State, or local officer, or member of an organized rescue or firefighting force the performance of an official duty.
Violation of these prohibitions is punishable by a fine of not more than $5,000 and imprisonment for not more than six (6) months, or both under the authority of Title 16 USC 551, Title 18 USC 3559 and 3571.
