Occupancy and Use

PROHIBITIONS

Pursuant to 36 CFR 261.50(a) and (b), the following acts are prohibited within the National Forest System Lands and Developed Recreation Sites within the Spring Mountains National Recreation Area, Humboldt-Toiyabe National Forest, described below and shown on the map (Exhibit A) incorporated into this order. The following order will be in effect year round from September 12, 2022 until September 11, 2027.

1. Entering or using a Developed Recreation Site or portion thereof during posted closures. 36 CFR 261.58 (b)

EXEMPTIONS

Pursuant to 36 CFR 261.50, the following persons are exempt from this order:

1. Persons with a permit specifically authorizing the otherwise prohibited act or omission.
2. Any Federal, State, or local officer or member of an organized rescue or fire fighting force in the performance of an official duty.

This order will apply to the following Developed Recreation Sites:

1. Spring Mountains Visitor Center Gateway
2. Kyle Canyon Picnic and Camping Area
3. Cathedral Rock Trailhead
4. Cathedral Rock Picnic Area
5. Mary Jane Falls Trailhead
6. Trail Canyon Trailhead
7. Deer Creek Picnic Area and Parking Lot
8. Hilltop Campground
9. Mahogany Grove Group Campground
10. Sawmill Picnic Area and Trailhead
11. Old Mill Picnic Area
12. Foxtail Group Picnic Area
13. McWilliams Campground
14. Lower Bristle Cone Trail Head
15. Cliff Rose Trailhead & Telephone Canyon Trailhead
16. Fletcher View Campground & Trailhead (Including Parking Lot)
17. Desert View Overlook Interpretive Site & Parking Lot
18. Echo Trailhead
19. Robbers Roost Trailhead
20. Juniper Trailhead
21. Upper Bristlecone Trailhead

PURPOSE

The purpose of this order is to promote public health and safety in areas that require extensive personnel to be available for successful management, as well as to establish hourly closures that correlate to available staffing to support the various Developed Recreation Sites.

IMPLEMENTATION

5. This order will be in effect September 12, 2022 at 17:00 pm and shall remain in effect until September 11, 2027 at 00:00am unless rescinded earlier.
6. Attachment A. Map is attached and incorporated into this order.

Violation of these prohibitions is punishable as a class B misdemeanor, by a fine of not more than

$5,000.00 for an individual or $10,000.00 for an organization and/or imprisonment of not more than 6 months [Title 16 USC 551, 18 USC 3571(b)(6), Title 18 USC 3581(b)(7}
