Off Highway Vehicle Road Restrictions Within Developed Campgrounds

PROHIBITIONS: 

Pursuant to Title 36 CFR 261.50(a) and 261.50(b), the following act is prohibited on the roads and areas described in this order, on the Cedar City and Pine Valley Ranger Districts, Dixie National Forest until further notice: 

1. Using any off-highway vehicle, as defined by Utah law in Utah Code Annotated Section 41-22-2, on a road or portion thereof that is posted as closed to off highway vehicles, to include all “All-Terrain Type I” and “All-Terrain Type II” vehicles, unless they have been modified to meet “street legal” requirements. Title 36 CFR 261.54(a) 

DEFINITIONS: 

1. "Off-highway vehicle (OHV)" means any snowmobile, all-terrain type I vehicle, all-terrain type II vehicle, all-terrain type III vehicle, or motorcycle. 
2. "All-terrain type I vehicle" means any motor vehicle 52 inches or less in width, having an unladen dry weight of 1,500 pounds or less, traveling on three or more low pressure tires, having a seat designed to be straddled by the operator, and designed for or capable of travel over unimproved terrain. 
3. "All-terrain type II vehicle" means any motor vehicle 80 inches or less in width, traveling on four or more low pressure tires, having a steering wheel, non-straddle seating, a rollover protection system, and designed for or capable of travel over unimproved terrain, and is: 
   1. an electric-powered vehicle; or 
   2. a vehicle powered by an internal combustion engine and has an unladen dry weight of 2,500 pounds or less.
4. "All-terrain type III vehicle" means any other motor vehicle, not defined in Subsection (2), (3), (12), or (22), designed for or capable of travel over unimproved terrain. 
5. "All-terrain type III vehicle" does not include golf carts, any vehicle designed to carry a person with a disability, any vehicle not specifically designed for recreational use, or farm tractors as defined under Utah law in Utah Code Annotated Section 41-1a-102 
6. “Street legal Motorcycle” means every motor vehicle having a saddle for the use of the operator and designed to travel on not more than two tires and compiles with: 
   • (i) traffic rules under Title 41, Chapter 6a, traffic Code; 
   • (ii) titling, odometer statement, vehicle identification, license plates, and registration, excluding registration fees, under Title 41, Chapter 1a, Motor Vehicle Act; and 
   • (iii) the county motor vehicle emissions inspection and maintenance programs under Section 41-6a-1642; (b)    a motor vehicle for: 
     • (i) driver licensing under Title 53, Chapter 3, Uniform Driver License Act; and
     • (ii) motor vehicle insurance under Title 41, Chapter 12a, Financial Responsibility of Motor Vehicle Owners and Operators Act; 

EXEMPTIONS: 

Pursuant to Title 36 CFR 261.50(e), the following persons are exempted from the prohibition contained in this Order: 

1. Persons with a Forest Service permit specifically exempting them from the effect of this Order. [Title 36 CFR 261.50(d)(1)] 
2. Any Federal, State, or local officer; or member of an organized rescue or fire fighting force in the performance of an official duty. [Title 36 CFR 261.50(e)(4)] 
3. Federal or State administrative personnel in the performance of an official duty. 
4. Snowmobiles (Over-Snow Vehicles) An over-snow vehicle is defined as “a motor vehicle that is designed for use over snow and that runs on tracks and/or a ski or skis, while in use over snow” from Dec 15th through April 15th 
5. When there is at least six-inches or more of snow. 
6. Street legal motorcycles. 

ROAD AND AREA DESCRIPTION: 

Developed campground roads or portions thereof on the Cedar City and Pine Valley Ranger Districts, Dixie National Forest that are listed and described in Attachment 1. 

PURPOSE: 

This order is intended to provide OHV access in campgrounds which have legal access to riding opportunities while also providing a quiet recreation experience at some locations. 

IMPLEMENTATION: 

1. This order will be in effect when signed and shall remain in effect until 02/13/2028 or until rescinded, whichever occurs first. Order Number: 0407-23-01 
2. The prohibitions in this order apply to roads or portions thereof that are posted with a standing post with a “Closed to OHVs” or “OHV ingress/egress only”. 
3. The prohibitions in this order will be made part of the Motor Vehicle Use Map (MVUM). 
4. A campground list and roads identifying the restrictions is attached and is made part of this order. 
5. Violation of the above prohibition is punishable by a fine of not more than $5,000.00 for an individual, or $10,000.00 for an organization, and/or imprisonment for not more than six (6) months. [Title 16 USC 551, Title 18 USC 3571(b)(6), Title 18 USC 3581(b)(7)}.

7. This order supersedes any previous order(s) prohibiting the same, or similar acts prohibited by this order in the areas covered by this order.
